Game Over: Judge Tosses GM Lawsuit Against Fiat Chrysler

General Motors’ racketeering lawsuit against rival Fiat Chrysler is dead in the water after a federal judge dismissed the case on Wednesday.

The move comes after GM appealed U.S. District Court Judge Paul Borman’s order that the CEOs of the battling automakers should meet in private and hash out a resolution themselves. The General won half of its appeal, and the meeting was scrapped, but Borman, who described the lawsuit as a “nuclear” option that only served to clog up the courts in a time of COVID-19, stayed on the case — against GM’s wishes.

Now, the case has come to an end, though the battle might still rage on.

Barra Gets Half: Appeals Court Nixes Make-Nice Meeting Between GM, Fiat Chrysler

General Motors saw half of its wishes granted this week, after an appeals court overturned an order by U.S. District Judge Paul Borman for the CEOs of GM and Fiat Chrysler to meet and settle their differences in person.

GM is suing FCA, accusing its crosstown rival of racketeering and claiming it lost billions of dollars via FCA’s bribing of UAW officials in return for a series of favorable, low-cost labor agreements. The General wants to go all the way with its case, but Borman stepped in, calling the suit a “nuclear” option. The in-person meeting is now off the table, but Borman’s still on the case.

Fiat Chrysler’s Serbian assembly plant was the first European auto factory to shut down as a result of the growing coronavirus pandemic — a grim harbinger of things to come, and not just for Europe.

That temporary February shutdown stemmed from a parts shortage arising from the hard-hit Chinese manufacturing sector. A far more prolonged shutdown came in mid-March, for obvious reasons. Well, that’s all over, as a crucially important product is now back in production, ready to satiate the hunger of the American buying public.

Despite new health measures incorporating physical distancing, barriers, and personal protective equipment, working on a factory floor is undoubtedly a tense experience for many these days. PSA-FCA Merger Doesn't Need Any Changes: Tavares

PSA Group CEO Carlos Tavares has bucked the notion that his company’s merger agreement with Fiat Chrysler Automobiles needed its terms massaged. Living through the coronavirus should be proof enough that automotive partnerships are essential for weathering the coming economic storm, and that governments shouldn’t stand in the way — or so goes the theory.

During PSA’s annual shareholder meeting on Thursday, the CEO suggested that the poor condition the global auto industry finds itself in makes this a poor time to discuss the issue. Tavares believes the unsavory conditions created by COVID-19 makes cost savings even more vital and that partnering with another automaker is its best bet to stay healthy. “The merger with FCA is the best among the solutions to cope with the crisis and its uncertainties,” he said.

Dodge Tops Them All in Initial Quality: J.D. Power

Come again? Yes, that’s the finding of J.D. Power’s latest Initial Quality Study, which examines consumer complaints over the first 90 days of vehicle ownership. As you can already see, there was plenty of disruption in the 2020 study.

Tesla, darling of both the tech and green crowds, finished dead last in the study, which ranks brands and individual models by problems experienced per 100 (PP100) vehicles. That finding comes with a caveat, however.

FCA Payday: Italy Readies $7.1 Billion for Automaker

Italy is on the cusp of approving a 6.3 billion-euro ($7.1 billion) loan for Fiat Chrysler Automobiles (FCA). Suppressed sales stemming from coronavirus lockdowns have encouraged governments around the globe to lend businesses a hand or — more accurately — fists full of money.

Bloomberg claims FCA’s payday will be Europe’s biggest government-backed financing of an automaker since the start of the pandemic, but it’s hardly the only company needing money. General Motors and Ford utilized credit lines to amass billions of dollars for their rainy day funds — and it’s definitely pouring outside. Ford figures it lost roughly $5 billion in operating costs in the three months leading up to June. Meanwhile, Fiat Chrysler estimates it lost $5.5 billion through the first quarter of this year.

Fiat Chrysler Automobiles’ battle to keep an Indian all-terrain vehicle — one that looks suspiciously like a certain flag-waving American off-road vehicle — out of the U.S. has come to an end. FCA won.

As reported by Bloomberg, the U.S. International Trade Commission has ruled that Mahindra’s Roxor, which strongly resembles a Jeep CJ, is in violation of section 337 of the Tariff Act of 1930 and infringes on the complainant’s trade dress. In short, the Mahindra Roxor looks too much like a Jeep.

FCA, PSA to Be Probed Deeply Ahead of Merger

Executives from Fiat Chrysler Automobiles (FCA) and PSA Group are reportedly concerned that their companies are in for an extensive probing by the European Commission before their planned merger can take place. Ideally, the duo have said they want to finalize the deal early in 2021, but the prolonged investigative dive may force them to readjust that timeline.

The European Union has historically been a big fan of antitrust investigations and often tries to predict future business actions to address how newly formed organizations might impact the market overall. It’ll be a difficult task, what with automotive sales suppressed by coronavirus lockdowns and the global economy looking particularly grim.

Few are under the impression that the merger will be blocked, however.

Good News for the Not-Quite-Eco Crowd: The Jeep Wagoneer Lives

We’ve talked an awful lot about fuel-sipping hybrids and virtuous electric vehicles in recent days; so much so, one could forget that a great number of buyers want nothing more than to take home the biggest, most spacious SUV on the road today. Ford sells plenty of Expeditions and Lincoln Navigators, and General Motors decided the time was right for an even larger Chevrolet Suburban, GMC Yukon, and Cadillac Escalade.

Big still sells, so it’s no wonder that Fiat Chrysler wants a piece of the action. It’s frankly bizarre that the automaker went the past decade without a full-size SUV.

Well, that streak will soon end, as there’s now rolling proof of the Jeep Wagoneer’s looming return.

The company should be generous to its locked-in user base, treating them as a resource, not a revenue stream.This is what builds any good relationship, generosity to the other partner. Apple does with their products. My iPhone is 5 years old, but I keep getting the latest and greatest updates for free, which makes me feel valued as a customer and adds actual value. When it is time for a new phone, Apple past treatment towards me certainly plays into my decisions (as did BMW's - so long subscription extracting pigs, its been a great 20 years). Imagine how much good will and love (and good press) Polestar would get from their user base if they gave them all a "68 fresh horses" update overnight, for free. Brand loyalty would soar (provided their car is capable).

  • ToolGuy In the example in the linked article an automated parking spot costs roughly 3% of the purchase price of the property. If I were buying such a property, I would likely purchase two parking spots to go with it, and I'm being completely serious.(Speaking of ownership vs. subscription, the $150 monthly maintenance fee would torque me off a lot more than the initial acquisition cost.)
