Profit From Punishment? Volkswagen's Preferred Emissions Penance Faces Criticism From State Officials and Automakers

Government officials and automakers are accusing Volkswagen of twisting its emissions-cheating penance to its own advantage. As part of its sentence for equipping over half a million vehicles with defeat devices, the United States is forcing VW to spend billions of dollars on a decade-long program that promotes environmentally friendly transportation and green technologies. The company opted to invest a large part of those compulsory efforts into establishing an EV charging network within the U.S.

However, seven state attorneys generals have urged the Environmental Protection Agency to closely monitor Volkswagen’s course. They contend that such a network would give the company an unfair advantage in the forthcoming electric revolution, allowing VW to profit from its misconduct.

EPA to Approve Diesel Repair for an Additional 84,000 Volkswagens: Report

The Environmental Protection Agency and California Air Resources Board will soon announce an approved fix for roughly 84,000 recalled Volkswagen diesels. As part of VW’s buyback program of cars equipped with emissions-cheating defeat devices, the soon-to-be-certified modification allows 2012-2014 Passat TDIs to operate within acceptable pollution guidelines.

Volkswagen has already designed fixes for the Generation 3 diesel 2.0-liter engines, providing vehicle owners the choice to keep and repair their car, or to have it bought back. Similar fixes in Europe have yielded complaints of reduced fuel economy, starting difficulties, trimmed power, weak acceleration, and even abnormal sounds. As usual, if you want to hold onto your TDI, you may be doing so at your own risk.

Justice Department Prepping for Lawsuit Against Fiat Chrysler

The U.S. Justice Department is preparing itself for a lawsuit against Fiat Chrysler Automobiles over, you guessed it, diesel-burning engines. Cetane-rated fuel has been a broad target for governments lately, but the forthcoming FCA suit is less concerned with what you’re burning than with how you’re burning it.

Officials are concerned the automaker may have used a defeat device after the Environmental Protection Agency accused it of using software that allowed about 104,000 diesel vehicles to emit excess emissions. The models in question are 2014-2016 Jeep Grand Cherokees and Dodge Ram 1500 trucks with 3.0-liter diesel engines.

Mazda Keeps Certifying the Mazda 2 With CARB, But Why?

It was January of 2015 and I was standing in a small venue in Montreal. The space was dark save some access lighting and red spotlights pointed at a sheet-covered car.

A few moments later, the sheet was pulled off, and Mazda Canada announced the 2016 Mazda 2 would be coming to The Great White North.

Eleven months later, Mazda Canada would reverse that decision, citing other all-new products — namely the CX-3 and MX-5 — requiring Mazda’s full attention. After all, the small automaker didn’t want to spread itself too thin, and it wasn’t like the previous-generation Mazda 2 set the sales charts on fire — on either side of the border.

In America, Mazda North America Operations had zero intention of selling the subcompact in any region other than Puerto Rico. Yet, year after year since the model went on sale in other global markets, Mazda continues to certify the Mazda 2’s emissions system with the California Air Resources Board, effectively making it eligible for retail sale in any of the 13 “CARB states” and District of Columbia.

No Mercedes-Benz Diesels for 2017, or Maybe Ever

Fans of German compression-ignition engines had best dig out those old, glossy posters of an olive green 300D, as they’re going to need it.

Daimler announced it will not sell 2017 diesel Mercedes-Benz models in the U.S. as rumors swirl that the automaker might give up on the segment altogether.

The problem lies in regulatory approval, which Daimler has struggled — and failed — to obtain. Following the Volkswagen diesel scandal, the Environmental Protection Agency and California Air Resources Board began going over diesel emissions with a fine-toothed comb. The four diesels Mercedes-Benz had hoped to sell in the U.S. this year became trapped in a bottleneck last fall.

After killing off the C300d’s prospects for good, the automaker then sought approval for just one model — the GLS350d. No dice. Investigations on both sides of the Atlantic could now cap the company’s 57-year diesel history in the U.S.

Johnson was on the front lines of the scandal and was among the first managers the EPA publicly reached out to in September of 2015, but it seems that may have been a ploy not to blow his cover — he had already spoken to the California Air Resources Board a month earlier.

California has green-lit light-vehicle pollution targets that the Trump administration has placed under review. As expected, t he Golden State is going to continue playing hardball over Environmental Protection Agency regulations.

Already critical of the automotive industry for asking the president to reconsider federal guidelines through 2025, the California Air Resources Board hinted that it wouldn’t stray from the emission targets set by the Obama administration in 2012. On Friday, CARB finalized its state emissions rules while setting an updated ordinance on zero-emission vehicles. “We’re going to press on,” said Mary Nichols, head of the board, during last week’s press conference.

President-elect Donald Trump’s pick to head the Environmental Protection Agency, Oklahoma Attorney General Scott Pruitt, said he plans to review the Obama administration’s recent decision to secure fuel efficiency standards through 2025.

Last week, outgoing EPA administrator Gina McCarthy bumped up the timeline for the final determination on the fuel efficiency rule in the hopes of maintaining the Obama administration’s climate legacy.

“It merits review and I would review that,” Pruitt said at yesterday’s Senate confirmation hearing. Later that same day, Pruitt confirmed that he would not permit California to continue operating under its own rules as part of its 2009 advanced clean cars program and zero emission vehicle mandates.

As predicted, California isn’t interested in being told what to do.

Indictment: Volkswagen Updated Emissions Cheat in 2014, Hid It From EPA and CARB

On September 9th, Volkswagen engineer James Liang pleaded guilty after being indicted on a variety of crimes related to VW’s deliberate use of a software routine that cheated on government diesel emissions testing.

Until his guilty plea was entered in United States District Court in Detroit, Liang’s indictment was under seal. Now that it has been made public ( full PDF version here), we know more details about VW’s cheat and it turns out that the German automaker even updated the original software cheat — apparently to work more effectively — with a patch delivered in the guise of fixing emissions related warranty claims.

As the scandal was breaking, Volkswagen also deliberately supplied government agencies with false data to make the problem appear to be the result of a mechanical malfunction, not a defeat device.
