Another southwestern Ohio judge (Michael J. Sage)¬*has ordered¬*New Miami, a tiny locality¬*not far from the small¬*village of¬*Elmwood Place where a similar ruling which brought nationwide attention took place last year, to stop using automatic photo cameras:



"Questioning attorneys during more than two hours of legal arguments, Sage wondered aloud whether the speed camera system in the village, along a busy highway just outside this county seat city, were like taxing people for driving through."

Coincidentally, the Ohio state senate¬*held a 'third' hearing,¬*exactly one day after Judge Sage's ruling,¬*on¬*a bill to make¬*automatic speed cameras illegal¬*in the state (the same¬*bill¬*passed the Ohio state house by a two-thirds margin last year)¬*. No word as to what determination (if any) was made by the state senate.

Go OHIO! When I was a teen a judge ruled that unmarked police cars couldn't be used to pull over speeders.¬*

I'd love a little of that magic in my adopted home of New Mexico.¬*

In a related,¬*underhanded bit of chicanery, nearby Hamilton, OH, uses an unmarked Ford Escape with a photo camera to issue 'notices of liability'. They get around the marked enforcement vehicle requirement¬*because the Escape is¬*not¬*owned by the municipality, but supplied¬*by Redflex, the contracted¬*company that receives a¬*sizable chunk¬*of all money received.



In that regard, it's¬*worth noting that the two rulings¬*in Elmwood Place and New Miami¬*have been¬*against Optotraffic, a different company that uses a slightly different method to get their money. Optotraffic's cameras are trailered to their locations and are much¬*more difficult to move. They¬*don't move them¬*from¬*their location¬*(if at all) unlike¬*Redflex' highly mobile, photo-camera-equipped¬*Escape which is¬*driven to a new location daily. It¬*appears that¬*smaller jurisdictions prefer Optotraffic because there's less for them to do. Redflex' system requires someone local to move the vehicle around daily.



Regardless, it's a win-win for both the company and municipality. These companies (Redflex and Optotraffic) supply the equipment and set everything up, including receiving and processing¬*the money, for their cut of the loot,¬*while all the local government entity¬*has to do is sit back and rake in the cash (and¬*put the cameras¬*in locations¬*most likely to¬*generate the most money).

I don't know anyone who is pro-automated enforcement. And it begs the question, how do people get into a position of authority if they hold views that the vast majority of people don't. And then how do they get other people to go along with them?

Is this one of those things where enough people have to die and be replaced for things to make any sense? Or are we too deep in the pockets of whomever that no matter who is in charge, the dollar signs will be shining too brightly?
