Barney Frank: Ed Whitacre Is Overpaid, But What Are You Gonna Do?

It’s been over ten days since GM’s Bob Lutz took to the local papers to complain that GM’s executives are “way, way, way underpaid,” and its still been less than a week since Ed Whitacre’s $9m compensation package was announced but politicians are only now starting to sit up and take notice. Barney Frank (D-MA) can usually be counted on to give greedy CEOs a good dressing-down, but at this point, Mama Frank seems to have given up on the government-owned automaker’s execs. The Detroit News reports Frank’s mild disappointment thusly:

“I don’t think Mr. Whitacre was going to go do something else” if he got paid less, Frank told reporters this afternoon after a hearing. “He’s having a good time there. I think they way overcompensate themselves.”

Jim Press Phones Home

It’s not likely that former Toyota exec Jim Press wishes he had been called down to congress instead of Jim Lentz, but he may just be trying to angle for a return his old company. Press took time out of his busy schedule of job-hunting and worrying about taxes to write an (apparently unsolicited) email to Automotive News [sub]. Judging by the portions that AN [sub] did publish, it should probably have gone straight to Toyota’s CEO… or the shredder.

Toyota doesn’t want me to speak out, but I can’t stand it anymore and somebody has to tell it like it is. Akio Toyoda is not only up for the job, but he is the only person who can save Toyota. He is very capable, and he embodies the virtues and character that built this great company. The root cause of their problems is that the company was hijacked, some years ago, by anti-family, financially oriented pirates. They didn’t have the character necessary to maintain a customer first focus. Akio does.

Quote(s) Of The Day: Bookends Edition

QOTD is a fairly irregular exercise for us, but we’d be remiss if we didn’t dust it off for today’s marathon hearings before the House Oversight and Government Reform Committee. Needless to say, the ten-ish hour affair offered too rich a bounty of choice quotes to properly choose just one. And so we have two: the first and one of the last quotes of the day’s proceedings. The day opened with the following words from Chairman Edolphus Towns:

Good morning. I thank you all for being here. It is hard to imagine the horror of the event that took the lives of an entire family near San Diego, California on August the 28th, 2009. California highway patrolman, Mark Saylor, his wife, their 13 yr old daughter, and Mrs Saylor’s brother, Chris, were driving in a Toyota Lexus, a loaner car that the Toyota dealer provided while their car was being repaired. As they drove along the highway, suddenly the car… accelerating [sic] rapidly, he stood on the brakes, but nothing happened. No matter what he did, he could not stop the car from flying down the road, faster and faster. As this car reached top speed in just seconds, it was all he could do just to kep it under control. In a frantic call to 911, his brother-in-law, Chris, reported the gas pedal was stuck, the brakes did not work, and they were barreling down on an intersection. He yelled over the phone “hold one, hold on, hold on and pray. And those were his last words.”

NHTSA Has Electrical Engineers… But Where?

Before Transportation Secretary Ray LaHood even took the stand before the House Energy Committee, the Washington Post [via TheCarConnection] reported that:

NHTSA officials told investigators that the agency doesn’t employ any electrical engineers or software engineers.

Down on the Potomac, zingers like that go over like an ounce of catnip in a phone booth full of rowdy toms. And sure enough, the question came up at LaHood’s testimony. In fact, it came up twice. And it was the closest thing to a real “gotcha” moment in a long day of testimony.

After a big buildup by expert witnesses, and Toyota’s Jim Lentz’s evasion of any evidence that his firm’s cars are afflicted with an untraceable electronic gremlin, the House Energy Committe turned its attention to Secretary of Transportation Ray LaHood. Because LaHood’s department falls under the congress’s oversight (and carries the government’s ultimate responsibility for the safety of American motorists), LaHood might well have been the main focus of the committee’s investigation. And indeed his last-in-line billing appears to make him the event’s headliner. Or at least it would have if his testimony didn’t make the previous several hours of Ahab-ing largely unnecessary, and possibly even highly embarrassing.

I am Akio Toyoda of Toyota Motor Corporation. I would first like to state that I love cars as much as anyone, and I love Toyota as much as anyone. I take the utmost pleasure in offering vehicles that our customers love, and I know that Toyota’s 200,000 team members, dealers, and suppliers across America feel the same way. Has ABC News Found The Ghost In Toyota's Machine?

Ever since Toyota’s recent problems hit “frenzy” level on our mainstream media monitoring system, speculation has been rampant that some mysterious electronic problem was at the root of the unintended acceleration scandal. We’ve been wary of jumping on the “ghost-in-the-machine” bandwagon, for a number of reasons, chief among which is the fact that it seems to be the product of an inability to explain specific instances of unintended acceleration, rather than hard evidence. Given that unintended acceleration occurs at the intersection of man and machine, good old-fashioned human error is an easier assumption than mystery software errors. Given the worrying results of our Toyota gas pedal analysis, we’ve been content to explain the situation on a combination of pedals, mats and human error. But now ABC News may just have the first positive evidence of an electronic problem that could explain the mystery behind Toyota’s unintended acceleration problem. Dave Gilbert of Southern Illinois University has found that it’s possible to cause unintended acceleration without it triggering an error code that might give some kind of clue as to its cause. Combined with our finding that Toyota actively conceals data from its black box data recorders (out of line with standard industry practice), this could be some of the first positive evidence that there’s more to the “ghost in the machine” theory than mere panic-driven speculation.

Ask The Best And Brightest: Could The Toyota Recall Prove That There's No Such Thing As Bad Publicity?

The social media blog Mashable has an interesting theory: Toyota’s recall woes might actually be good (gasp) good for the brand. To back up this astonishing claim, they offer two premises, based on online social media data:

The first is that the increased number of conversations about Toyota are building greater awareness for the brand even though many of the mentions may be negative. While this may seem unusual, the fact that people are talking about the brand a lot more and sometimes in a neutral light (not just negatively) is increasing its exposure. More people are talking about Toyota than any other brand these days. And they’re talking about the recalls, but also the fixes being provided by the dealerships too. And some of the consumers are probably coming to the defense of the brand too. Maybe there is some truth to the adage that there’s no such thing as bad publicity after all.

GM Fighting Colorado Culled-Dealer Bill

The Colorado House’s passage of HB-1049 [ PDF here], a bill requiring restitution for dealers culled during the Chrysler and GM bankruptcies, has drawn a $60,000 “no” campaign from General Motors. The Denver Post reports that GM’s ad campaign, which features lines like “we must keep driving forward to repay our government loans,” and “don’t let special interests stick taxpayers in reverse,” has riled up local lawmakers more than ever, drawing such timeless put-downs as: “they must be spending tax dollars on Botox to say that with a straight face.” The bill would require OEMs compensate culled dealers for signs, parts, dealer upgrades and more, as well as offer them the right of first refusal for any new area dealerships.

Would You Trade Places With A Chrysler Dealer?

It’s not a question that should leave many folks on the fence, but apparently there are at least a few Detroit-area journalists who might be willing to consider the career change. “Dealers optimistic about Chrysler’s future” proclaims the Detroit News headline from NADA’s annual convention. A more accurate headline (such as USAToday‘s “Chrysler dealers face new-model drought”) probably should have included the term “punch-drunk” to better explain this unexpectedly sunny outlook. One grizzled ChryCo dealer sums up the mood with aplomb:

We’re the toughest fighters. We’ve always been 3 or 4 (in the marketplace). We’ve never been spoon-fed. We have to fight for every piece of ground… There’s light at the end of the tunnel; I just don’t like the length of the tunnel.

BMW: Out With The "Ultimate," In With The "Joy"

BMW has ditched its long-running “Ultimate Driving Machine” tagline in favor of the vague, lifestyle-y “We Make Joy” promise. And though advertisers never tire of explaining that products themselves pale in comparison to the feelings they inspire in their owners, much of BMW’s (and most German luxury brands’) appeal comes from a projection of sachlichkeit, or single-minded obsession with something for its own sake. “The Ultimate Driving Machine” expressed the brand’s practical and emotional values in a simple, original phrase. The new line might open the brand to more non-enthusiast consumers, but it also reeks of the kind of marketing done by firms that don’t have top notch products on the market (usually because of a distinct lack of institutional sachlichkeit). Lutz: GM Execs "Way, Way, Way" Underpaid

Everyone in every business everywhere thinks they are at least somewhat underpaid, and for most, there’s a certain amount of truth to the sentiment. But then, most Americans don’t have jobs that allow them to destroy billions of dollars in value over the course of their careers. Nor does the Detroit News give most of us a forum to whine about our perceived underpayment. Having helped lead GM into bankruptcy and bailout (with thousands of Americans losing their jobs along the way), Bob Lutz still isn’t happy about executive pay limits at GM, and he clearly has no compunction about airing his grievances to the DetN.

What you see is what you get, and it ain’t a lot. All I know is, right now, we are given our responsibility, and given the rigors of the job and demands and the accountability, I would say we are being paid way, way, way below market. Right now, that isn’t a problem, but over time, clearly a company that undercompensates senior executives is going to have a retention or recruiting problem

The Toyota case is heading towards hearings in DC and to courts all over the country. Both sides are putting heavy artillery in position. Both sides of the SUA wars commission heavy caliber studies – both with inconclusive results. Toyota funded a study into the electronics in its vehicles. Before that, a group of lawyers had “sponsored” Safety Research and Strategies, a company that makes money by investigating auto-safety for those suing auto makers. Ford, which had been at the receiving end of an SRS fusillade during the Explorer crisis, called the company “supposed safety advocates who are actually just shills for trial attorneys.”

Toyota Lawsuits Breaking Out All Over

As we fumble towards a more complete understanding of Toyota’s stunning fall from grace, we’ve only uncovered a single class of people who truly stand to benefit from the last several weeks of hysteria: the lawyers, of course. Thanks to Toyota’s deep reserves of cash, every single possible damage incurred in the last several weeks will be picked over for an opportunity to sue the world’s largest automaker, and already the suits have crossed over into the realm of the absurd. Automotive News [sub] reports on latest class-action suit charge against Toyota, which seeks damages from the automaker for diminished resale value and lost use of recalled vehicles. These charges have been filed as class-action suits in “at least 30 states,” and lawyers suggest that the damages could run as high as $2b. Ford paid Explorer owners $500 a piece when it settled similar class-action suits in the wake of its Firestone safety scandal.

The Product Development Pause That Refreshes

Fiat/Chrysler CEO Sergio Marchionne was supposed to give a speech in conjunction with the Chicago Auto Show today, but backed out at the last minute, sending Dodge honcho Ralph Gilles in his place. The Chicago Sun Times was able to snag an interview with the globetrotting CEO though, and it features some of Sergio’s more candid (if confusing) comments on the state of new product development at the New New Chrysler. Of particular interest is his very apt criticism of Cerberus’s mismanagement of new product development, specifically the decision to replace the 300 before the Sebring.

The biggest market segments in the United States are the C [midsize cars] and D [large luxury vehicles] segments. If you only have a dollar to spend that’s where you go spend it, especially if you’ve got products that are structurally not working.

The decision was made to invest elsewhere. So we developed a brand-new platform for the 300, a decision that took capital that may have been required elsewhere to go play in a different sandbox. Until you’re clear about where you need the money, where the money needs to be spent to ensure longterm survival – that part of it was substantially missing.

Acura: All We Need Is Advertising

Despite spending $264.1 million on measured media in the first 11 months of 2009, up 16.5 percent from the year-ago period [per AdAge monitoring] while sales fell nearly 27 percent, Automotive News [sub] reports that Acura is upping its 2010 ad spend by 50 percent. According to Acura’s advertising boss Steven Center, Acura’s awareness levels have been consistently high, but consumers didn’t perceive it being as prestigious as other luxury brands. By boosting advertising of new products like the ZDX and TSX Sportwagon, Center hopes to close the gap with the premium perceptions of its German competitors. Center explains:

Our messaging for years has been too ill-focused and not about the product. The ads weren’t making the point and the point is: What is it about Acura that makes it better? We want to have the emotion of BMW without the hardware,

You know, instead of being seen as higher-content, uglified Hondas. Yeah, more advertising should help with that.

Under Criticism, Obama Soft-Pedals LaHood's Toyota Criticism

Transportation Secretary Ray LaHood’s get-tough quotes during the Toyota recall have generated significant backlash against an administration that is already knee-deep in the automotive industry. The governors of Mississippi, Kentucky, Indiana and Alabama (all of which host Toyota plants) laid into the NHTSA and Obama administration in a letter covered by the Detroit News. The governors argue:

Despite the federal government’s obvious conflict of interest because of its huge financial stake in some of Toyota’s competitors … it has spoken out against Toyota, including statements U.S. government officials have later been forced to retract… Toyota must put the safety of drivers first and foremost. However, they deserve a level and reasonable response from the federal government – one that is not tainted by the federal government’s financial interest in some of Toyota’s competitors

Strangely, the governors of Texas and West Virginia, where Toyotas are also assembled declined to sign onto the letter. Still, the attack isn’t being simply written off has home-state selfishness. One bellwether for the issue is the fact that the Detroit News looked past its own hometown interests and ran an editorial by the Cato Institute’s Daniel Ikensen, amplifying the governors’ critique. And sure enough, Obama decided to take the issue on head-on in an interview yesterday.

Akio Toyoda Getting Ready For A DC Grilling

Toyota’s president Akio Toyoda was already getting ready to “visit the United States over massive recalls of its vehicles,” reported the Nikkei [sub]. Japan’s transport minister Seiji Maehara told U.S. Ambassador to Japan John Roos that Toyoda would be dispatched to DC. There, he would be ready to “explain the recall problems to the U.S. Congress if asked.”

Toyota Refuses Eco-Award For Prius

Every year, Japan’s Ministry of Economy, Trade and Industry hands out prizes for products it regards as the pinnacle of energy-efficiency and eco-friendliness. This year, Toyota’s Prius was chosen as the recipient of the grand prize.

Last Monday, Toyota said “enryo shimasu” (no thanks) to the Ministry, and refused to accept the governmental honors, an industry ministry official disclosed today to the Nikkei [sub].

With Friends Like These: Southeast Toyota Dealers Pull ABC Ads Over Recall Coverage

Toyota’s PR efforts have been competent if muted during the ongoing recall scandal. Though it could certainly have done more in the past weeks (specifically by making top leadership more available to the public) Toyota has carefully avoided overreacting to the mushrooming media frenzy. Until now. The NYT’s Wheels Blog reports that the 173 Toyota dealers who make up Toyota Southeast have pulled regional ads from ABC stations because of “excessive stories on the Toyota issues.” Toyota Southeast’s ad agency 22Squared says “We have counseled the client on the pros and cons of this, and ultimately it was their decision to make.” Toyota continues to run corporate ads on ABC, but the petulant backlash from its Southeast dealers can’t help but reflect poorly on the brand. Any PR pro will tell you (and presumably 22Squared counseled its clients of this), that these kinds of strong-arm tactics do nothing to improve public perceptions of a brand. Toyota dealers might feel that the parent company is not doing enough on the PR front, but this approach will only create the need for more PR in the future.

Toyota's Jim Lentz Digg Dialogues

Perhaps the biggest surprise of Jim Lentz’s appearance on Digg Dialogue was the number of questions that were unrelated to Toyota’s ongoing recalls and quality issues. But even if crowdsourcing had yielded a number of truly tough questions, Lentz had access to them ahead of the interview, giving him time to craft slippery answers. Still, the session provides an interesting of a preview of Toyota’s defense ahead of tomorrow’s congressional hearing. The main thrust: unintended acceleration is mysterious phenomenon, and finding a common cause for multiple incidents could be nearly impossible. Unless investigators find a ghost in Toyota’s electronics code, that may be as good of an answer as we’re ever going to get.

As Hearings Loom, Toyota And Congress Gear Up For Battle

Toyota heads up to Capital Hill tomorrow to face the ire of the U.S. House Committee on Oversight and Government Reform in a hearing that’s been subtly named “Toyota Gas Pedals: Is the Public at Risk?” A memo by committee staff [via the WSJ] sets a paranoid tone for the hearing, as the NHTSA investigation widens beyond gas pedals alone:

Attention is now being focused on the electronic throttle control system (ETC) to determine whether sudden acceleration may be attributable to a software design problem or perhaps to electromagnetic interference. The committee staff found numerous complaints made to NHTSA describing sudden acceleration that was not caused by either floor mats or sticky pedals.

Toyota’s Yoshi Inaba will face the brunt of the questioning, although Transportation Secretary Ray LaHood and NHTSA administrator David Strickland will surely face questions about their oversight of Toyota (or lack thereof).

Toyota Recalls: (Un)intended Ambiguity?

Readers of the Nikkei [sub] were greeted this morning with the purported news that by the end of this month, Toyota “is expected” to recall its Sai and Lexus HS250h hybrids, which use the same braking system as the Prius hybrid. Furthermore, “the company is believed to have decided” to recall the current Prius, “and is expected” to notify the Transport Ministry of the plan early this week.

Prius Recall, Or Not? Toyota, A Mass Producer Of Confusion

After piles of books have been written about the „Toyota Way,“ this round of recalls will have a permanent place in the annals of how to completely NSFW-up crisis management. The epicenter of the disaster at Toyota is not in the pedal dept., it is not in the software development dept., it is in the Public Relations Department in Toyota City. Or possibly, right at the top.

Last Friday evening, Toyota trotted out their CEO and founder’s grandson Akio Toyoda to address the complaints about Prius brakes. Toyoda said nothing of substance. What irked the public, and what became instant fuel to the already raging fire, was that Akio Toyoda refused to address the fact that Toyota had changed the Prius software, and changed the braking hardware in January, for cars in production. People wanted to know what happens with the cars they had already bought. Akio Toyoda left his customers in a lurch. Answering in very bad English instead through an interpreter made matters worse.

A day later, Reuters wrote that Toyota will recall the Prius “in the next few days.” Who was the source? A Toyota spokesperson? Nah. A “person close to the matter?” Nope. The source was a Toyota car dealer. “Toyota officials were not immediately available to comment.”

Today, the Nikkei [sub] writes that Toyota “has decided to recall and repair free of charge the latest model of its Prius hybrid sold in the domestic market due to complaints over brake problems.” And who’s the source? A Toyota spokesperson? Nah.

BREAKING: Toyota To Recall 270k 2010 Priuses, Similar Problems Reported On Ford Hybrids [Updated With Ford Press Release]

According to MSNBC, Toyota’s US-based spokesfolks are refusing to confirm a Nikkei report that Toyota has issued a recall of 270,000 2010 model-year Priuses for brake issues the company has already acknowledged. “We have no information on any decision to recall the Prius,” said Toyota Motor Sales USA spokesman John Hanson, who said the company is working with the NHTSA on a “preliminary evaluation” of the problem. According to another report, the recall (which will be filed “shortly”) involves 100k Priuses in the US market, with the remaining 176k in Japan.

While Toyota may or may not recall the Prius, Ford is not recalling its Fusion and Mercury Milan Hybrids for what appears to be a similar issue (poor transitions between regenerative and conventional brakes). Instead, Ford is instituting a “Customer Satisfaction Program” involving free software upgrades it says will fix the problem, which was first reported by Consumer Reports.

UPDATE 2: While we sort some of these late-breaking developments out, here’s another spurious log for the fire: ABC News impugns “federal investigations were extremely limited in scope, after negotiations involving former safety investigators who had been recruited to work for Toyota’s Washington, D.C. office.”

Ford Sales Up 25 Percent In January On Fleet Buying Binge. Retail Numbers Down 5 Percent

Ford’s sales momentum continues unabated, as the Blue Oval has announced that its January sales were up 25 percent over January 2009 [full release in PDF format here]. Sales were led by a a strong performance from Ford-branded cars, which were up 54 percent as a category, with individual nameplates logging gains ranging from 33 percent (Focus, 10,389 units) to 121 percent (Taurus, 3,768 units). Ford Crossovers and SUVs were up 16.7 and 12.9 percent respectively, with most of the volume gains coming from CUVs like the Escape (+28.6%, 10,753) and Edge (+25.5%, 6,243 units). Ford truck sales were up 14.5 percent, with heavy commercial vehicles falling and the Ranger recording a strong 47.3 percent gain to 4,143 units.

Lentz: Don't Like The Gas Pedal Fix? Insist On Replacement!

One of the lingering concerns over the Toyota recall is whether Toyota’s “precision steel” shim fix to the recalled CTS gas pedal assembly will be a reliable long-term solution. Our analysis indicates that these questions might be well-founded, and we’re not the only ones concerned about the viability of Toyota’s proposed fix. In an interview with Toyota’s Jim Lentz yesterday evening, NPR asked why Toyota was using a redesigned pedal for new production, but only offering the shim fix to existing customers. Lentz insisted that the repaired pedals would be as good as the redesigned pedal, that the costs of repair and replacement were about the same, and that the main reason Toyota was repairing rather than replacing recalled pedals was the desire to “get customers back on the road… as quickly as we possibly can.” That’s when NPR went for the jugular.

"Based on GM's Experience, the Vibe is Safe to Drive." Or Not.

Say what? GM has no problem kicking Toyota when its down, offering conquest cash to craven Toyota owners who might be tempted to flee the brand in the midst of recall mania, but its own handling of the situation deserves some analysis. After all, GM confirms that its Pontiac Vibe is assembled at the GM-Toyota NUMMI joint venture using the CTS-sourced pedal assembly that allegedly causes unintended acceleration. And yet The General went on the record last Friday [via Automotive News [sub]] essentially claiming that its Toyota Matrix rebadge was magically safe from the dread terrors afflicting its Toyota-badged cousin. Now GM has revised its statement on the Vibe, admitting that since the Toyota recall, it has received several complaints about sticking accelerators on Vibes (although no related wrecks have been reported). Better late than never… unless you’re making the pitch that consumers should choose you over Toyota because you will take better care of them. [UPDATE: GM reports that the Vibe’s brakes can stop the vehicle. Go figure]

House Launches Toyota Investigation, Hearings Scheduled

Staff from the House Energy and Commerce Committee met with representatives from Toyota yesterday, reports Automotive News [sub], as Congress wades into the Toyota recall debacle. According to a letter from the Energy and Commerce Committee to NHTSA administrator David Strickland and Toyota North America Boss Yoshimi Inaba [letters available in PDF format here], the discussions with Toyota were characterized as “helpful,” but that “it left important questions unanswered, including when Toyota learned about this serious safety defect and what actions the company took to investigate and resolve the hazard.” Hearings have been scheduled for February 25, and the Committee’s letter to Inaba requests disclosure of all internal communication related to to the production shutdown, among other company documents.

Toyota Update: CTS Blames Toyota, Already-Produced Vehicle Retrofitting Could Take Years

Supplier CTS, who produced the gas pedals now under recall from Toyota, tells Automotive News [sub] that it “built parts to the automaker’s specifications and says it has no knowledge that its parts were responsible for any accidents or injuries.” Sources at CTS tell AN that although they are working on a fix with Toyota and that new pedals have been tested and are shipping to Toyota plants, “this is their recall.” That would seem to contradict the facts of the case, as Denso, Toyota’s gas pedal supplier for Japanese-built models, has not been involved in the recall. According to Inside Line, the issue with pedal return damping that has plagued CTS-supplied, US-built Toyotas has not turned up in Denso-produced gas pedals.
